    Default Rental Problems

    Hi guys,

    Having a little problem.......

    Our landlord (downstairs manager) issued a 'Entry Notice' to enter our premises on 25/8/06 to show a prospective buyer through.

    When we got home today we had a 'Notice to Remedy Breach' under our door dated 24/8/06. Basically the unit wasn't as clean as he would like therefore a breach.

    When we got home yesterday (24/8/06) our balcony door was shut and we don't shut it. Pete thought that he had entered our premises on this day without issuing us an 'Entry Notice' for the 24/8/06.

    My question is....... How can we get a breach removed when he didn't have the right to enter our premises?

    Any legal experts? Moe?

    It just so happens our lease runs out before the date on the 'Notice to Remedy Breach'. Its tempting to just vacate but we will probably get hit with respect to bond etc.

    Do you have a lease ? If yes, read it. If no, he can probably do what he likes within reason.

    Yes i have a lease.....

    to enter the premises he has to issue a 'Entry Notice' with respect to the appropriate time for notice... ie... 24hrs for showing people through, 7 days for an inspection.... etc.

    He did not give us a notice to enter on the 24/8/06... therefore he has entered our premises, written a report, given us a 'Notice to Remedy Breach', without actually having the right to enter in the first place.

    maybe it's a sign....you and pete should settle down, buy a house and start a family.

    If you want to make an issue of it, I'm sure you could go to the relevant body for renters (the name escapes me).

    If he was coming on the 25th, would you have cleaned up enough that there would have been no breach. Just clean it to his requirements by the notice date. If you have to let him have another check, just clean up then tell him to come through.

    I've had to look after several units for FIL and I'll tell you being a landlord is a bitch. But so is being a tennant. I doubt he wants any trouble. And a notice to rememdy breach for a place that might not be as clean as he'd have liked is really a minor breach and easily remedied. But they have these multitude of form for a reason.

    If you want to vacate, as long as the breach is remedied by the time you leave then he shouldn't have any reason to withhold any bond. If he does you can take it to the rental bond authority - that's what they're there for.

    I say take it on the chin, clean up as you would have for the 25th, then either stay or leave. No big.

    i'm sure pete is saving his pennies as we speak...

    unless he's spending the money on a plethora of drivers???

    probably..... i'm betting on the stable of drivers getting bigger before i get a ring...

    We did clean it up on the 24th for the 25th ..... thats why we are so pissed off.
