Interesting that he is claiming against the small Australian company selling the club and not the large American company who produced the allegedly 'faulty' product.

Because they know they wouldn't have a hope against Ping! But maybe they can back Drummond into a settlement, then Trilby Misso can take their 50+% for less work!

PHOENIX — An Arizona couple accused of sexual abuse after taking bath-time photos of their children and then trying to have them developed at Walmart are suing the state and the retail giant.

Lisa and Anthony "A.J." Demaree's three young daughters were taken away by Arizona Child Protective Services last fall when a Walmart employee found partially nude pictures of the girls on a camera memory stick taken to the store for processing, according to the suit.

The Peoria couple's attorney said Walmart turned the photos over to police and the Demarees were not allowed to see their children for several days and didn't regain custody for a month while the state investigated.

I was witness to a very similar experience while at university, poidda. One of the girls in my photography class took some photos of her baby brother in the bath - nice B+W artsy pics. She developed them in the darkroom (as we had to) but also decided that she would get a few of the good ones professionally developed, so dropped off the negatives to Teds in the city.

Long story short, she had a very awkward conversation with the police who were assigned to investigate her after the pictures were reported.

Yeah I'm all for it being reported etc, but surely common sense should kick in at some stage without the kids having to be taken away from the family. And it seems it did in your situation.

If it was in the states, he'd get millions. What a load of BS. What was Drummond supposed to do? Pull the grips and inspect every shaft before sale?

What ever happened to common sense in this world?

I watched a short video on that yesterday. I felt really bad for the family. Due to the sensitivity of the topic, precautions must be taken. However, the photos were so innocent, common sense should have prevailed.

I've only ever seen 1 club break in a similar spot, and that was after my playing partner had thrown it at least 40m after duffing one in a fairway bunker. Next shot it broke right in the middle of the grip

The guy must have slammed it into the ground to weaken it?

If it was me, and I hadn't done anything wrong with the club I'd seek legal advise though

tough call. the potential for a big payout has to be tempting. not sure i could live with myself for claiming it though. the guy has suffered legitimite injury, loss of function etc, but i don't see how Drummonds is liable.

I have had a new driver shaft snap under the grip mid swing... I got nothing when I went back to the store... lucky it was a cheap shaft.

I understand the legitimacy of his injury, but bloody hell, in this day and age someone always has to be to blame. In poorer countries this would never happen. We have inherited this crap from the USA, and people should not be able to live with themselves if they get a big payout.

There is no way Drummonds have any liability.

The blokes a wanker.It was bad luck.I've had 2 clubs break under the grip(they were a couple of years old though) and have seen plenty more that have snapped there.

He should have just let ping know what happened and I'm sure they would of looked after him well.

"You would expect a national retailer like Drummond Golf would have ensured that the equipment it sells is of the highest standard and not a safety risk."

Just a case of naming the easiest defendant and that's the people who sold it.

Drummonds will join Ping as co defendant to argue their liability is reduced or negated in whole.

Any firm would do the same thing. The defendants and ultimately the insurers will argue amongst themself. Ultimately it sounds like payout time to the plaintiff as long as he can prove there was no contribution to the dodgy club.

The lesson = Ping make shit clubs!

Its moot who is liable anyway as Drummonds and Ping both would (should?) have public indemnity insurance so it wont cost them a cent apart from increased premiums.

As for the club breaking, i have had several break in mid swing like that, and on each occasion it was obvious the club was already dinged up in that spot.

The guy sounds like he has a genuine case for a claim, and I probably would sue myself if indeed the impact of the injury was serious, but it might be very hard to prove that the product itself was faulty.

He was off work for several months and is still unable to move the finger making simple tasks like writing, typing and cooking very difficult.
